For decades, victims of sexual harassment in Malaysia had limited legal recourse. The criminal route under the Penal Code (sections 354, 355, 376, and 509) existed but required proof “beyond reasonable doubt” of malicious intent, a high burden that was difficult to meet for non-physical or “minor” incidents. Civil tort claims were slow and expensive.
